IP and Unfair Competition Litigation at the ITC


The International Trade Commission (“ITC”) is a powerful and popular venue in which to enforce intellectual property rights, with the primary remedy being exclusion of infringing products from the U.S. market.  The SABA-DC IP Section has assembled an experienced panel to discuss the lure and lore of the ITC where we will address (i) critical differences between ITC and district court litigation, (ii) the types of IP being litigated at the ITC, and (iii) key Commission and Federal Circuit decisions affecting ITC practice. 


Our panel includes:


Goutam Patnaik is a partner in and co-chair of the Intellectual Property Litigation Practice Group of Pepper Hamilton LLP and serves on the firm’s Executive Committee.  Mr. Patnaik concentrates his practice on intellectual property and commercial matters, including patent, trademark and copyright disputes.  Mr. Patnaik has experience with Section 337 investigations before the International Trade Commission (ITC), as well as district court litigation. He is currently teaching ITC Policy and Procedure as an adjunct professor at George Mason University School of Law. He has litigated matters involving a variety of industries and technologies, including integrated circuit design, sucralose manufacturing, wireless conference calling devices, NOR and NAND flash memory devices, online medical monitoring systems, interactive online lottery products and wireless technology. His transactional experience includes negotiating and drafting licensing agreements for the development, use and maintenance of software applications in the banking and insurance industries, as well as numerous patent licenses and other IP-related agreements.


Tuhin Ganguly is an associate in the Intellectual Property Litigation Practice Group of Pepper Hamilton LLP. Mr. Ganguly focuses his practice on patent litigation and particularly on Section 337 patent litigation at the International Trade Commission.  He has experience litigating cases involving a wide variety of technologies including digital imagining technology, integrated circuits, software and web applications, telecommunication systems, digital music equipment, and automobile airbag sensors.  In addition to patent litigation at the ITC and in district court, Mr. Ganguly has experience prosecuting patent applications, performing portfolio evaluations, rendering validity and infringement opinions, licensing intellectual property, and counseling clients with respect to strategic portfolio development and monetization.  Prior to becoming a patent attorney, Mr. Ganguly was a protein biochemist at Monsanto.


Asha Allam is an associate at Adduci Mastriani & Schaumberg LLP.  She is an intellectual property and international trade attorney focusing on Section 337 investigations of unfair competition before the U.S. International Trade Commission (ITC).  She represents complainants or respondents before the ITC in a broad range of industries including semiconductors, household appliances, and consumer electronics and accessories. Ms. Allam specializes in the rigorous economic analysis required in Section 337 investigations and has experience in all aspects of an investigation, including pre-filing due diligence and post-investigation enforcement efforts.  Ms. Allam is also a contributing author to the second edition of the American Bar Association’s book entitled "A Lawyer’s Guide to Section 337 Investigations Before the U.S. International Trade Commission."


The panel will be moderated by Akarsh Belagodu.  Akarsh is an associate in the Patent Litigation Practice Group of Kilpatrick Townsend & Stockton LLP where he litigates patents in district courts, the Patent Trial and Appeal Board, and the International Trade Commission.
