IN-HOUSE AND PTAB JUDGE PERSPECTIVES ON EX PARTE PATENT APPEALS

 

Please join us for a luncheon discussion of ex parte appeals practice before the Patent Trial and Appeal Board (PTAB). Our panelists will discuss practice before the PTAB, including in-house and PTAB perspectives on the challenges presented by changing standards in the law, strategies for improving the quality and effectiveness of appeals, reasoning and strategy in selecting issues and arguments for appeal, expectations for outside counsel, and use and impressions of pre-appeal programs.  

 

PANELISTS:

 

Kal Deshpande – Administrative Patent Judge, USPTO

 

Judge Deshpande received a J.D. degree from The Ohio State University, Michael Moritz College of Law and a Bachelor of Science degree in Engineering from Case Western Reserve University. Judge Deshpande, subsequent to his graduation from college, worked for Accenture. During and after law school, he worked at the early-stage food services company Viands Concerted, LLC. He then joined the United States Patent and Trademark Office as a Patent Examiner before joining the Board in 2008 as a Patent Attorney.

 

Shruti Costales – Patent Counsel, HP Inc.

 

Shruti Costales is Patent Counsel at HP Inc. with over fourteen years of experience in patent application preparation, patent application prosecution, patent counseling, transactional matters, and litigation matters. Prior to HP Inc., Shruti was in private practice for about thirteen years. During this time, Shruti worked for a mid-sized law firm and two patent boutiques. She also successfully founded and ran her own patent boutique for over six years. Shruti is also a former patent examiner in the polymers and fuels technology areas. Her technical experience includes undergraduate research on drug delivery systems and working as an engineering intern at Fortune 500 chemical and pharmaceutical companies. Shruti earned a BS in Chemical Engineering from Purdue University in 2000 and a JD from Franklin Pierce Law Center (now University of New Hampshire School of Law) in 2003. Shruti is Vice Chair of the Intellectual Property Owners Association's Women in IP Committee and she is also the Vice Chair of the Diversity Committee for the PTAB Bar Association.  

 

Thara Russell (Moderator) – Patent Attorney, Bookoff McAndrews PLLC

 

Thara Russell helps her clients to assess and improve the strength and defensibility of patents and IP portfolios in multiple technological areas. She has a strong background in patent litigation, and has represented clients through pre-trial, trial, and post-trial procedures in U.S. district courts, as well as in AIA post-grant proceedings.  This experience allows her to consider the long-term strengths and weaknesses of patents, patent file histories, and portfolio growth strategies as she represents her clients before the USPTO.
