    RACIAL JUSTICE SENIOR STAFF ATTORNEY:

    Job Summary:

    The Center for Health Law and Policy Innovation (CHLPI) advocates for legal, regulatory, and policy reforms to improve the health of underserved populations. Our work on behalf of low-income people focuses on improving access to high quality health care, reducing health disparities, and promoting more equitable and effective health care and public health systems. The racial justice senior staff attorney (“staff attorney”) will identify and advance issues of racial justice and equity across the broad spectrum of CHLPI’s advocacy portfolio, including federal and state health policy reform, administrative and legislative advocacy and impact litigation. The staff attorney will also be afforded some discretion to identify new matters within CHLPI’s areas of expertise, with an eye toward adding an explicit and focused racial justice component to our law practice. To meet these goals, the staff attorney will work with diverse stakeholders, including consumers, advocates, community-based organizations, health and social services professionals, government officials and others, as well as with CHLPI’s staff and students.

     

    Job Specific Responsibilities:

    As a Racial Justice Senior Staff Attorney, you will:

    • Serve as the lead attorney on one or more CHLPI projects to increase access to health care and the quality of health care for low-income individuals and families, explicitly working toward racial justice and equality goals.
    • Develop new and support existing policy reform, administrative advocacy and/or impact litigation projects with a general goal of reducing racial and socioeconomic disparities in health and public health systems. 
    • Liaise with other CHLPI attorneys to enhance the focus on pursuing goals related to racial equity across the organization’s initiatives.
    • Supervise and mentor students on a broad range of relevant skills.
    • Review government and government-funded health care policies for racially disparate impacts subject to antidiscrimination law.
    • Audit and address health insurance policies that further entrench systemic racism.
    • Work with state-based advocates to develop progressive health care policy reforms targeted at increasing access to care for communities of color. 

     

    Basic Qualifications:

    Candidates must have a J.D. and be admitted to a state bar. Five years or more of related experience required.

    The Clinical Fellow works under the supervision of the Center for Health Law and Policy Innovation (CHLPI) clinical instructors to advocate for legal, regulatory, and policy reforms to expand access to high-quality healthcare; to reduce health disparities; and to promote more equitable and effective health and public health systems. This position represents a unique opportunity to work within Harvard Law School’s clinical program, to join a dynamic public interest and clinical teaching health and public health law and policy clinic, and practice in burgeoning areas of state and national importance.

    Job Specific Responsibilities:

    As a clinical fellow, you will:

    • Serve as the lead attorney on one or more Health Law and Policy Clinic (HLPC) projects to increase access to health care and the quality of health care for low-income individuals and families, explicitly working toward racial justice and equality goals.
    • Manage and direct the day-to-day work of one or more of HLPC’s impact litigation cases, including the work necessary to design, administer and prosecute a successful lawsuit.
    • Collaborate with other attorneys across the country on various litigation projects including amicus briefing, cocounseling, and litigation consultation. 
    • Support efforts to ensure that justice-oriented processes and goals are fully integrated into our work to improve the health of vulnerable populations living with HIV, HCV and other chronic health conditions.
    • Collaborate as a team member on HLPC projects with clinical staff and students on policy development and advocacy, building upon and extending CHLPI’s innovative work in health and public health law and policy.
    • Work closely with students on the projects that the Fellow oversees and support student development in skills including problem-solving, law and policy analysis, research and writing, oral communication, time and project management, and leadership.
    • Participate in office-wide projects and in the Center’s program as a laboratory for innovation in legal practice and clinical legal education.  
    • Help to set and implement the vision for the ongoing development and success of the Clinic.

    About the Office: 

    The FBI's Office of the General Counsel (OGC) is seeking highly qualified attorneys to join its exciting and challenging legal practice.  OGC provides legal advice to the entire FBI, including the Director, FBI Headquarters officials and agents in the 56 domestic field offices, on a wide range of substantive issues.  OGC works closely with the other elements of the Department of Justice (DOJ), other members of the Intelligence Community, including the Office of the Director of National Intelligence (ODNI), the Central Intelligence Agency, the National Security Agency, and the White House.  OGC also assists the FBI in forming partnerships with other federal, state, local and international agencies, as well as private sector entities, in support of FBI operations.

    Legal Forfeiture Unit (LFU):  The Department of Justice Asset Forfeiture Program encompasses the seizure and forfeiture of assets that represent the proceeds of, or were used to facilitate federal crimes.  The goals of the FBI's Asset Forfeiture Program are to punish and deter criminal activity by depriving criminals of property used in or acquired through legal activities; promote and enhance cooperation among federal, state, local, tribal, and foreign law enforcement agencies; recover assets that may be used to compensate victims when authored under federal law; and ensure the asset program is administered professionally, lawfully, and in a manner consistent with sound public policy.  Attorneys working in the FBI's Legal Forfeiture Unit utilize the asset forfeiture sanction to remove the profit from crime; dismantle existing and emerging organized criminal enterprises and terrorist organizations and disrupt those activities which threaten the physical or economic security of the United States and its allies.  LFU Attorneys also apply their legal expertise and education by providing legal oversight, review, advice, and training for all aspects of the FBI's asset forfeiture program.

    Job Description: 

    Trial attorneys in Office of Constitutional and Specialized Tort Litigation - Vaccine Litigation Staff - represent the interests of the Secretary of the Department of Health and Human Services in all cases filed in the U.S. Court of Federal Claims under the National Childhood Vaccine Injury Act ("Vaccine Act"). The cases involve claims of injury as a result of the receipt of vaccines covered by the Act. The position offers a unique experience in public service and involves trial practice. The legal and medical issues at stake in each case vary. Trial attorneys independently manage heavy caseloads, and while streamlined procedures are utilized, many cases involve complex scientific issues of causation that require employment of experts in medical fields such as pediatrics, neurology, immunology and epidemiology. In cases in which petitioners are found entitled to compensation, the litigation often requires retention and management of experts to develop an appropriate life care plan for the injured party - to include medical treatment, remedial care, rehabilitation, calculation of lost earnings, actuarial projections and structured settlements.

    Attorneys appear frequently before the Office of Special Masters in the U.S. Court of Federal Claims, and also appear before the judges of the Court, as well as in the U.S. Court of Appeals for the Federal Circuit when handling appeals. Responsibilities include factual and legal research, medical record review, brief writing, and working with expert witnesses to develop the defense of claims, as well as to address the life care needs of vaccine-injured petitioners. As the majority of cases are resolved through settlement, attorneys also engage regularly in settlement negotiations, including alternative dispute resolution, and drafting settlement memoranda and related documents. Due to a recent increase in cases filed under the Vaccine Act, the office is expanding to address the additional workload.
