    Duties  The incumbent will be responsible for a full attorney caseload in the Public Advocacy Section, focusing on civil enforcement actions against failures to pay, including fraudulent failures to pay, required tuition for non-resident students who have attended public schools in the District of Columbia.  These actions will include actions under the False Claims Act for treble damages and civil penalties, as well as collection actions under the Non-Resident Tuition Act.  Duties will extend to all aspects of civil enforcement at the trial court level, including investigating the residency of students for whom tuition has not been paid, evaluating allegations of fraud, drafting complaints for filing in the D.C.     The Criminal Section prosecutes adults who commit certain types of offenses within the District of Columbia.  Specifically, the Section prosecutes all traffic offenses, including impaired driving; quality of life offenses; fraud of government agencies; and certain other offenses relating to the agencies. 

     

    The Public Safety Division is seeking candidates for the position of Trial Attorney/DUI Prosecutor for the Criminal Section.  The selected candidate will work under the supervision of the Section Chief and Assistant Section Chief to enhance the Section’s prosecutions of impaired drivers.

     

    The Assistant Attorney General/DUI Prosecutor will specialize in prosecuting drivers impaired by alcohol and/or drugs in order to enhance the effectiveness of the Section’s impaired driving prosecutions, to ensure that all appropriate impaired driving arrests are prosecuted vigorously, to focus on those cases that involve the highest alcohol scores, impairment by drugs, children in the vehicle, commercial drivers, and/or repeat offenders, as well as to work towards prevention by providing education at local high schools and colleges regarding the penalties for impaired driving.  The individual selected for this position will work with the Traffic Resource Safety Prosecutor (TSRP) and another DUI Prosecutor to serve as one of the Criminal Section’s expert on impaired driving issues, to coordinate with law enforcement on impaired driving investigations, and to coordinate the training of other Criminal Section prosecutors and of law enforcement personnel. 

     

    Responsibilities for this position include:

     

    •   Assist in training OAG attorneys and law enforcement on how to prosecute impaired driving cases, including assessing training needs and the development of training programs.

    •   Assist in training of and assistance to law enforcement in methods of evidence gathering, especially newly emerging technology and trial techniques that will improve the ability of prosecutors to effectively prosecute impaired driving cases.

    •    Prepare briefs, legal memorandum and other pleadings for use at hearings, trials, or on appeal of such cases assigned to the DUI Prosecutor.

    •   Assist in improving the laws in the District so that adequate punishment is available which would serve as a deterrent, including reviewing and drafting legislation.

    •   Serve as a resource for prosecutors by offering expertise and assistance in prosecuting impaired driving offenses as well as technical assistance and legal research on a variety of issues including probable cause; Standardized Field Sobriety Testing (SFST); Drug Evaluation and Classification (DEC) Program; implied consent; breath/blood testing; accusatory instruments; pre-trial procedures; trial practice; and appellate practice.
      
    •   Assist in improving the breath, blood, and urine testing program.

    •   Serve as a liaison, develop and maintain a rapport and with the District’s toxicologist and the Certifier of Breath Testing Instruments on techniques used to analyze samples.
      
    •   Serve as a regular and full participant in the Impaired Driving Task Force.
     
    •    Promote heightened awareness by law enforcement officers and prosecutors of victims’ issues.

    •   Serve as second chair on difficult impaired driving cases, including but not limited to Frye, Daubert, other suppression hearing, motions, etc.

     

    The successful candidate must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the bar.  If you are not a member of the District of Columbia Bar, you must be sworn into the District of Columbia Bar within 360 days of your initial hire as an attorney with the bar.  The successful candidate should also have prior criminal litigation experience, including jury trial experience, preferably as a prosecutor.  Knowledge of D.C.     The mission of the DC Department of Housing and Community Development (“DHCD”) is to create and preserve opportunities for affordable housing and economic development, and revitalize underserved communities in the District of Columbia.  DHCD focuses on three strategic objectives: (1) preserving and increasing the supply of quality affordable housing; (2) increasing homeownership opportunities; and (3) revitalizing neighborhoods, promoting community development, and providing economic opportunities.  To help meet the housing needs of the city’s low- to moderate-income residents, DHCD operates programs for individuals, developers, and community groups.  DHCD also ensures the preservation and maintenance of affordable rental housing by regulating building sales and conversion, administering the Rental Housing Act of 2006 (“Rental Housing Act”), and by enforcing the Tenant Opportunity to Purchase Act (“TOPA”).

    DHCD is currently seeking an attorney to become an Attorney-Advisor in its Office of General Counsel.  The Office of General Counsel is currently made up of a General Counsel, Deputy General Counsel and five other attorney-advisors.

    The incumbent will serve primarily as one of two transactional attorneys in the General Counsel’s Office for the Department of Housing and Community Development who support the Property Acquisition and Disposition Division (PADD) of the Department of Housing and Community Development (DHCD).  PADD’s mission is to acquire vacant District property that constitutes slum and blight, bundle individual properties, and dispose of them to developers who agree to rehab the properties, or build new homes, and make them available for low and moderate income housing.  The incumbent provides legal services to the PADD program managers by drafting contracts of sale and other transactional documents pertaining to the acquisition of vacant and abandoned properties.  Once acquired, the incumbent continues to assist the program managers in readying the properties for ultimate disposition to developers by negotiating and drafting disposition and development agreements.  In addition, if the developer does not live up to the commitments in the agreements, the incumbent provides advice, negotiation strategy, and drafting of documents that result in the District’s “recapture” of the properties.  The incumbent also provides legal assistance for the recapture of “Homestead” properties – properties that were conveyed under the former Homestead Preservation Program to low income individuals who agreed to rehab them and live in them for a period of time, but failed to do so.  Incumbent will also support of the Development Finance Division at DHCD by drafting and closing loans funded by the Community Development Block Grant program, HOME Investment Partnership program and the Housing Production Trust Fund.

    The Commercial Division of the Office of the Attorney General for the District of Columbia is seeking Procurement Attorneys to fill several newly created positions within the Procurement Section.  Attorneys will provide legal services for the District’s acquisition of goods and services.  They will advise agencies in drafting and solicitation of all contracts.  The attorneys selected for these positions will work almost exclusively on procurement matters. These new positions are critical to ensure that this Section is able to deliver procurement services in an efficient and effective manner.  The attorneys will review contracts for legal sufficiency, handle protests, and provide general advice.       

     

    The successful candidate must have a law degree and be an active member in good standing of the bar of any jurisdiction.  If you are not a member of the District of Columbia Bar, you must be sworn into the District of Columbia Bar within 360 days of your initial hire as an attorney with the District.

    Responsibilities and Opportunity Offered: The Criminal Division, U.S. Department of Justice, is seeking qualified, experienced attorneys for term positions or detail assignments in the Fraud Section located in Washington, DC.

    The incumbent will serve as a Trial Attorney in the Securities and Financial Fraud (SFF) unit or Foreign Corrupt Practices Act (FCPA) unit and, as such, independently direct, conduct, and monitor investigations, prepare and conduct trials, and advise on pleadings and other court filings. As a Trial Attorney, the incumbent:

    In collaboration with unit managers, develops and maintains the Section's program to foster effective national investigation and prosecution of securities and financial fraud or FCPA violations, including advising on strategy and legal complexities, and developing litigation priorities, policy, and legislative recommendations.

    Makes charging decisions and proposes dispositions with regard to assigned cases, and advises less experienced attorneys in very complex cases, issues lacking precedent, and other challenges that require such leadership.

    Partners with and leads U.S. Attorneys and attorneys in other federal law enforcement agencies in the development and management of securities and financial fraud or FCPA prosecutions. Advises and renders assistance in the preparation, critical examination and review of pleadings and in preparation of trial briefs. Evaluates reports of investigation and memoranda from U.S. Attorneys to determine whether litigation is warranted and whether proposed settlements are in the government's interest. Advises and instructs U.S. Attorneys on complicated questions of law and Departmental policy.

    Represents the United States in direct negotiations and discussions with state, county and city officials throughout the country, lawyers, and high level officials in some of the largest corporations in the United States. Participates in discussions with opposing counsel for defendants and in the formulation of settlements often having far-reaching legal consequences.

    Advises and consults with the Assistant Attorney General, Deputy Assistant Attorney General, Section Chief, et al., reporting on the status of all cases and matters related to civil/criminal remedies in the enforcement or the defense of statutes within securities and financial fraud or FCPA litigation.

    Serves as an expert, providing advice and policy determinations in matters involving the planning, discussion and coordination of the activities related to the litigation of securities and financial fraud or FCPA cases. Oversees the preparation and litigation assignments of lower graded attorneys, paralegals and clerical personnel.

    Qualifications Required:

    Required Qualifications: Interested applicants must possess a J.D. degree, be duly licensed and authorized to practice as an attorney under the laws of any State, territory of the United States, or the District of Columbia, be an active member of the bar in good standing, and have at least four (4) years post J.D. legal experience, one of which was specialized experience at, or equivalent to, the GS-14 grade level. Examples of specialized experience include: independently performing legal analysis; composing pleadings, briefs and other court documents involving unique and/or difficult legal issues in civil or criminal litigation; conducting highly complex civil or criminal litigation; and leading paralegals and support staff.

    Preferred Qualifications: Your qualifications will be further evaluated based upon the following competencies and experiences. You are required to respond to each competency in the occupational questionnaire portion of this announcement. Failure to respond to these questions may result in your being deemed not highly qualified for the position.

    Qualifications will be further evaluated based upon the following:

    • Experience as a criminal prosecutor.
    • Knowledge of white collar criminal litigation.
    • Experience in supporting, litigating, and supervising federal or state criminal cases.
    • Experience in U.S. District Court or state court.
    • Experience conducting investigations of organizations and entities, including corporations.
    • Experience with the federal judiciary.

    Travel: Domestic and International travel will be required.

    Position and Salary Information: These positions are for permanent appointments and detail assignments. The salary for these positions is at GS-15, $124,995 – $157,100 per annum, including locality pay.     If a vacancy is filled as a detail assignment, there is no change to the employee's base pay.
