Job Description: 

OPR is seeking an experienced attorney for its headquarters in the Main Justice building at 950 Pennsylvania Avenue, N.W., Washington, D.C. The attorney will be responsible for reviewing and analyzing allegations of misconduct and, where appropriate, conducting a thorough investigation of the allegations, including witness interviews and reviewing documents, and preparing a comprehensive report addressing the allegations and setting forth OPR’s findings and conclusions. The attorney may also be assigned special projects.

Job Description: 

This position reports to the Section's Deputy Chief for Policy. Policy Unit attorneys serve the interests of the Department by interacting with the interagency, particularly the State Department, Office of National Drug Control Policy, the Department of Defense and other federal, state and local governing bodies and agencies to develop, implement and monitor the implementation of national and international drug strategies pertaining to the Controlled Substances Act, and the 1961, 1971, and 1988 United Nations Drug Conventions.  Policy Unit Attorneys also monitor, study, and advise the Assistant Attorney General for the Criminal Division, the Chief of NDDS, and other policymakers within DOJ regarding the aforementioned statutes and treaties, and draft legislative or administrative amendments if needed, to address emerging drug trends requiring supplemental legislation, administrative scheduling changes, or other additional laws or regulations. Policy Unit attorneys directly advise litigation teams in ongoing civil or criminal cases, and in some instances directly serve on trial teams; assist foreign governments in drafting effective counter-narcotics legislation; and are also responsible for appellate litigation arising from decisions of the DEA Administrator, both through briefs and oral argument before United States Courts of Appeal. 

Policy Unit attorneys also respond to inquiries from multiple sources, including United States Attorney’s Offices, relating to substantive and procedural litigation matters and policy matters.

Trial Attorney

Job Description: 

The Executive Office for United States Trustees (EOUST), Office of the General Counsel (OGC) is seeking experienced attorneys to provide expert legal advice and guidance on employment law matters. The individuals selected for these positions will serve as agency experts in personnel and employment law matters, including advising on disciplinary and other adverse actions, and will be responsible for administrative litigation before the EEOC and MSPB.

As a Trial Attorney (Employment Law), GS-0905-14/15, duties and responsibilities will include, but are not limited to:

• Serving as a legal consultant and an expert on employment law issues concerning USTP operations.
• Providing senior management with expert legal advice and substantive recommendations regarding employee conduct standards, investigations of misconduct, and proposed disciplinary actions.
• Representing the USTP in actions before the federal District Court, MSPB, the EEOC, and other proceedings before an administrative body or a person having quasi-judicial power and providing litigation support to Department of Justice counsel who represent the USTP and its personnel in employment law matters before the federal District Court.
• Providing legal review of grievances and other employee complaints, claims, allegations and issues of entitlement.
• Reviewing for legal sufficiency proposed adverse actions, other disciplinary measures, and other personnel actions based on misconduct and performance and ensuring actions are supported by admissible evidence or documentation and that the action is in full compliance with personnel laws, regulations, and applicable case law.
• Providing advice and training on all aspects of employee relations and employment law.
• Formulating legal policies, procedures, and objectives related to employee relations and employment law.
• Proactively recommending improvements to the USTP's employee relations and equal employment opportunity programs, in compliance with applicable laws, rules, regulations, and Department and USTP policies.
• Providing legal assistance and advice in other areas of law including ethics, the Privacy Act, and the Freedom of Information Act.
• Performing other duties as assigned.

Job Description: 

The incumbent will serve as a Trial Attorney in the MIMF Unit and, as such, will independently direct, conduct, and monitor investigations, prepare for and conduct trials, and advise on pleadings and other court filings.

Generally, as a Trial Attorney in the MIMF Unit, the incumbent:

• Evaluates reports of potential criminal violations of the commodities, securities, and financial fraud laws from both internal and outside sources to determine whether investigation is warranted.
• In collaboration other Trial Attorneys and unit managers, carries out and develops effective investigations and prosecutions. Recommends charging decisions, proposes dispositions, and navigates assigned cases through all phases, including grand jury proceedings, pretrial litigation and motions hearings, trials, plea hearings, sentencing hearings, and post-conviction proceedings before U.S. District Courts across the country.
• Routinely leads teams of federal agents from the FBI, USPIS, IRS, FDIC-OIG, and others.
• Drafts legal process and utilizes domestic and international evidence collection tools, including subpoenas, search warrants, and Mutual Legal Assistance Treaties.
• Advises on strategy and legal complexities, and in developing litigation priorities, policy, and legislative recommendations.
• Partners with and leads Assistant U.S. Attorneys and attorneys in other federal law enforcement agencies in the development, management, and trial of complex white collar and corporate investigations and prosecutions. 
• Conducts investigations in parallel to federal agencies including, but not limited to, SEC and CFTC; works with consultants and experts; analyzes relevant data and evidence.
• Collaborates with foreign prosecutors and foreign law enforcement officers on international investigations. 
• Represents the United States in direct negotiations and discussions with corporate counsel and high-level officials. Participates in discussions with opposing counsel for defendants and in the formulation of settlements often having far-reaching legal consequences.
• Advises and consults with the Assistant Attorney General, Deputy Assistant Attorney General, Section Chief, et al., reporting on the status of all cases and matters related to civil/criminal remedies.

Legal Director - The Role

In coordination with the Executive Director, the Legal Director makes high-level strategic and vision decisions. The Legal Director coordinates and supports our independent and largely self-directed legal team, and oversees the day-to-day operations, systems, and processes of our programmatic work. Job Description: 

The Environmental Torts Section, Civil Division, U.S. Department of Justice defends the United States in complex, high stakes civil litigation in federal courts nationwide. Its attorneys directly handle all aspects of wrongful death, personal injury, and property damage cases that often involve hundreds, even thousands, of plaintiffs. The cases typically stem from alleged exposure to environmental contaminants, such as biological agents, chemicals, and other substances. They also involve complex issues of causation, novel issues of federal and state law, and numerous expert witnesses. Given its unique expertise, the section has primary litigation responsibility for all suits brought against the United States under the Federal Tort Claims Act where the alleged injuries/damages are attributed to some form of an environmental contaminant. Many of the section's cases are litigated as mass torts or multidistrict litigations. Mass tort cases being litigated by the section relate to: alleged damage to water systems and personal injury claims due to the military's use of per-fluorinated compounds in firefighting; personal injury claims stemming from EPA's oversight of state and local entities involved in the Flint water crisis; natural resource damage and personal injury claims related to an alleged heavy metals release during an EPA investigation at Gold King Mine in Colorado; personal injury claims related to alleged groundwater contamination at Camp Lejeune, North Carolina; World War II era chromium contamination from a former Air Force base in California allegedly causing groundwater contamination; and damages from alleged contamination and remediation at Hunters Point Naval Shipyard. Complex jurisdictional questions, a need for creative case-management solutions, and overlapping issues of history, law, and science are often the norm. At capacity, the section is comprised of approximately thirty attorneys and ten members of support staff.

This position reports to the Deputy General Counsel.  However, the incumbent also has significant collaborative interaction with the General Counsel and attorney colleagues in the office.  The work of the attorney selected for this position involves research, review, and analysis of relevant administrative and judicial decisions and other applicable authorities to provide legal advice or opinions to constituent clients to assist them to formulate administrative policy or to make difficult management decisions; providing written advice on the legal ramifications of new or proposed regulations; and reviewing agency policies and procedures to ensure legal compliance, recommending changes, as necessary.  The attorney chosen for this position may have opportunities to conduct or be involved in administrative litigation, including representing JMD in bid protests at the Government Accountability Office, contract disputes at the Civilian Board of Contract Appeals, employment discrimination matters at the Equal Employment Opportunity Commission, personnel and whistleblower matters at the Merit Systems Protection Board, and, as appropriate, to assist litigating divisions and USAOs when JMD matters are in the federal courts.  The selectee will have opportunities to advise contracting personnel on an on-going basis about Department procurements.  The selectee may also have opportunities for involvement in cooperative work with attorneys and executives of other components and agencies regarding matters, initiatives, or projects of mutual concern or interagency responsibility, including working closely with the Office of Inspector General with regard to debarments and suspensions.

The United States Attorney’s Office for the District of Maryland is seeking applications from attorneys who are willing to accept unpaid temporary positions that offer a valuable opportunity to gain exposure to the work of an Assistant U.S. Attorney (AUSA) without making a long-term commitment. Successful applicants will serve as Special Assistant U.S. Attorneys (SAUSAs) in the Greenbelt office with responsibilities for collateral litigation that may include legal research and brief writing in the subject matter areas of the First Step Act, including compassionate release; assisting others in the Office with the preparation of First Step Act motions and other collateral matters; arguing motions and handling sentencing and other proceedings related to collateral matters; providing support to the Bench in addressing First Step Act and other post-litigation issues; and potentially handling proceedings in the U.S. Court of Appeals for the Fourth Circuit. SAUSAs will also have opportunities to observe a wide range of legal proceedings. These positions require a minimum commitment of six months and may continue for up to one year. SAUSAs will not be hired by this office as Assistant U.S. Attorneys during their SAUSA terms. They may apply for AUSA positions in the Office after completing their service as SAUSAs.
