    LSIC will celebrate 50 years this fall as a nationally recognized leader at training social justice advocates and representing clients in grave legal jeopardy in the District of Columbia.  Recent signature achievements of the organization include:
     

    • Excellence in Teaching - A staff of eight full-time faculty teach, supervise, and mentor law students in a clinical program designed to meet American Bar Association standards for clinical training.  LSIC’s Housing Advocacy and Litigation Clinic (HALC) and the Criminal Defense Clinic train approximately 45 student attorneys from D.C. area law schools each semester.
    • Expanded Client Representation – Physically located in the Landlord and Tenant Branch of D.C. Superior Court, LSIC’s Eviction Defense Services (EDS) is the only legal provider that is open every hour that the Court is open and on Wednesday nights and Saturday mornings.  Through EDS and LSIC’s other clinical programs, law students, supervising attorneys, and staff attorneys provide representation to more than 4,000 clients each year and devote nearly 30,000 hours of pro bono legal services.  
    • Innovations in Justice and Equity – LSIC has a legacy of innovation, developing groundbreaking programs around expungement and immigration, launching a Civil Protection Order Project to represent respondents in intrafamily protection order cases, and pioneering the integration of social work students with clinical legal education.  
     
    Position Summary:
    LSIC is seeking a new Executive Director to build on a 50-year legacy of passionate and committed legal services, a strong and stable organizational foundation, and a recent expansion and new vision to increase educational programming and legal and social services.  Reporting to a Board of Directors and directing a staff of 30, the new Executive Director will lead the organization to and through its next exciting chapter of growth and impact.

    The National Education Association (NEA) is America’s oldest and largest labor organization with some 3 million members. The mission of the NEA is to unite our members and the nation to fulfill the promise of public education by preparing every student to succeed in a diverse and interdependent world.

    NEA seeks an attorney with at least two years of experience to join our eleven-member legal team in the NEA Office of General Counsel as a Civil Rights Law Fellow. The Fellowship provides a unique opportunity to work on the cause of advancing student civil rights with experienced counsel and other education advocates.

    NEA represents teachers, education support professionals, social workers, graduate students, teachers, professors, and other educators in our nation’s public schools. NEA works on many fronts to advance the cause of public education, to improve the working lives of school employees, and to ensure equal access to educational opportunities for all children. NEA’s work includes substantial advocacy at the federal, state, and local level in support of public education, students and educational employees, as well as significant research and policy initiatives to promote educational quality and funding.

    The NEA Civil Rights Law Fellow works out of NEA’s Office of General Counsel at NEA’s headquarters in Washington D.C. The fellowship is for a period of one year (through August 31, 2020), with the option of extending, upon mutual agreement, the fellowship for one additional year. The Civil Rights Law Fellow supports NEA’s work to ensure that students receive the full and equal educational opportunities to which they are entitled under the law. Over the past few years, NEA’s student civil rights advocacy has included all of the following:

     Development of, and training of members and advocates on, comprehensive legal guidance on Students’ Rights Not to Be Discriminated Against or Harassed Based on Race, Religion, National Origin, and Immigration Status available on this page. NEA’s guidance provides educators with an understanding of current laws that protect students from racial, religious, and national origin harassment; provides a model policy that school districts should adopt to ensure those protections are fully enforced; and provides FAQs and responses to assist in enforcement efforts.

     Development of, and training of members and advocates on, the NEA Safe Zones Policies and Resolutions to protect students’ rights to attend public schools regardless of immigration status. The policies and resolutions, which are available on this page, provide school district activists and leaders with tools to reaffirm and protect undocumented students’ rights to enroll and remain in public school.

     Development of, and training of members and advocates on, the NEA Legal Guidance on Transgender Students’ Rights, available on this page, which provides educators and districts with the current state of the law on transgender students’ rights, model trans-inclusive student policies, FAQs, and other resources.

     Guidance for NEA affiliates and members seeking to support student walkouts over gun safety and related issues, available here.

     Extensive litigation and amicus work, including in the following cases:

    o Participating as an amicus in two of the pending cases challenging DACA’s repeal including the trial court litigation that secured the national injunction staying DACA’s repeal. In University of California v. DHS (and associated cases), NEA filed this amicus brief in the Ninth Circuit in support of one of the injunctions on behalf of a broad coalition of education groups including state education unions, the Association of California School Administrators, multiple California school districts, the California School Boards Association, and a number of national groups. The brief focuses on the critical void that DACA educators fill in schools, particularly in light of teacher shortages nationwide and a lack of diversity in the teaching force (despite the increasing diversity of public school students) and the harm to students and schools that DACA’s rescission has caused. In New York v. Trump/Batalla Vidal v. Nielsen, NEA filed a similar amicus brief in the Second Circuit on behalf of the National School Boards Association, AASA, the School Superintendents Association, the American Federation of School Administrators, education unions, and other public education organizations.

    o Feminist Majority Foundation v. University of Mary Washington, No. 17-220 (4th Cir.), in which NEA filed in support of female university students who had been subjected to online, anonymous, peer harassment and threats. The NEA amicus discusses the impact that cyber-bullying and harassment has on students and makes the points that the trial court holding that schools have no duty to prevent and remedy such harassment is wrong and, if not reversed, would have an incredibly harmful effect on the educational opportunities of girls, LGBTQ students, and students of color.

    o Doe v. Boyertown Area School District, No. 17-3113 (3d Cir.) and Parents for Privacy v. Dallas School District, No. 18-35708 (9th Cir.), in which NEA filed in support of a trans-inclusive policies adopted by the school districts. The NEA amici detail how trans-inclusive policies both allow transgender students to thrive while also improving the overall school climate for all students. The briefs further argue that preventing schools from adopting trans-inclusive policies is deeply harmful to both transgender students and educators.

    o Smith v. Board of Education of Frederick County, Maryland, No. 17-2302 (D. Md.), in which NEA and our state affiliate moved to intervene to defend the Frederick County Teachers Association, who had successfully urged their school board to adopt a trans-inclusive student policy only to have that policy challenged in court by right-wing organizations contending that the policy was unconstitutional.

    Responsibilities: The Student Civil Rights Fellow will:

     Provide legal analysis, advice and counsel, and training on student civil rights and related issues to NEA staff, affiliates and members.

     Assist in handling litigation representing NEA, its affiliates and members related to student civil rights.

     Monitor and analyze student civil rights legal developments of interest to NEA and its members and provide regular updates on other developments of interest to NEA lawyers throughout the country.

     Assist in developing NEA’s strategic legal initiatives related to student civil rights.

     Assist with other legal matters (internal and external) as needed.

    Qualifications:

     J.D. from an accredited law school required.

     Two or more years of post-graduation legal experience (judicial clerkships preferred).

     Excellent oral and written advocacy and communication skills.

     Demonstrated commitment to civil rights, students’ rights, and workers’ rights.

     Ability to perform complex legal analytical work.

     Self-motivated and able to manage a variety of tasks concurrently.

     Demonstrated ability to work independently as well as within in a team.

     Healthy respect for colleagues.

    • 1.       Staff Attorney, DC Office - This role is for an experienced litigation attorney who is able to develop and lead litigation from day one. The ideal candidate for this position will have significant and successful experience with trial court and appellate litigation.
    • 2.       Staff Attorney, Community-Based Initiatives  -  We are looking for an experienced litigator with some specialized subject matter expertise. Experience with the Resource Conservation and Recovery Act and state solid waste law; the Comprehensive Environmental Response, Compensation, and Liability Act; and litigation involving toxic and hazardous substances, contaminated-environments, and health injuries related to toxic exposures are all pluses.     Job Title: Managing Attorney

    Specific Functions: Assist the Executive Director in maximizing the impact, and ensuring the smooth and efficient functioning, of the law firm. Serve as the administrative manager of the law firm, and mentor and supervise attorneys (as needed) and legal assistants. (Supervision of attorneys is not anticipated to include authority over case selection or require regular review of legal work product.) The Managing Attorney serves on Public Justice’s Management Team. This position does not litigate. Occasional travel, between Public Justice offices in Washington DC and Oakland, CA and to various Board events will be required.

    Administrative Management of Public Justice Legal Programs & Staff

    • Serve as day-to-day administrative and personnel manager of Public Justice’s legal staff and helps foster an inclusive, collaborative and supportive work environment
    • Support and coach attorney supervisors (Project Directors, managers of fellows and interns) to excel in carrying out their management responsibilities

    OCIE’s Office of Clearance and Settlement

    The Office of Clearance and Settlement (OCS) within OCIE is responsible for examining clearing agencies, some of which have been designated as systemically important financial market utilities. OCS conducts risk management examinations, develops reports of findings, and provides advice and recommendations for examinations of registered and exempted clearing agencies

    Office of Compliance Inspections and Examinations

    OCIE protects investors through administering the SEC's nationwide examination and inspection program. Examiners in Washington, DC and in the Commission's 11 regional offices conduct examinations of the nation's registered entities, including broker-dealers, transfer agents, investment advisers, investment companies, private funds, the national securities exchanges, clearing agencies, the nationally recognized statistical rating organizations, the Financial Industry Regulatory Authority ("FINRA"), the Municipal Securities Rulemaking Board, and the Public Company Accounting Oversight Board. OCIE’s mission is to protect investors, ensure market integrity and support responsible capital formation through risk-focused strategies that: (1) improve compliance; (2) prevent fraud; (3) monitor risk; and (4) inform policy. The examination program plays a critical role in encouraging compliance within the securities industry, which in turn also helps to protect investors and the securities markets generally.

    Job Details

    • Conduct research on various laws/rules/regulations, notably the Payment, Clearing and Settlement Supervision Act of 2010 (Title VIII of the Dodd Frank Act) and the Clearing Agency Standards (Rules 17Ad-22(a)-(c) and (e) of the Securities Exchange Act of 1934).
    • Review and analyze a variety of documents related to risk management examinations; and develop recommendations to resolve problems or issues encountered in an assigned area of specialization or focus.
    • Gather evidence to support preliminary findings of violations, and prepare reports of findings as well as correspondence to an entity outlining deficiencies and corrective actions to be taken.
    • Review and assess corrective actions taken by registrants in response to examination findings to determine compliance with applicable rules and regulations, and making recommendations to supervisors regarding resolution of concerns.
    • Work with senior examiners and attorneys in the writing of legal memoranda describing relevant law and factual bases to support referrals of examination findings to other divisions or offices.
    • Facilitate conferences and interview a variety of company personnel concerning operational and examination issues to determine possible regulatory violations.
    • Represent the SEC in meetings with staff of other federal agencies and the securities industry, respond to inquiries concerning the work of the SEC, and maintain productive work relationships with federal and state agencies and the industry.

    Minimum Qualifications:

In addition, applicant must have two years post J.D. experience as a practicing attorney, one year of which was in the specialty area of the position to be filled and which has equipped the applicant with the particular knowledge, skills, and abilities to successfully perform the duties of the position OR possess a LLM and have one year post LLM experience as a practicing attorney.

    Desired Qualifications:

    • Experience identifying, managing, monitoring and mitigating risks of regulated financial services firms.
    • Knowledge of the risk management operations of clearing agencies or any other entity that operates a multilateral system for the purpose of transferring, clearing, or settling payments, securities, or other financial transactions among financial institutions or between financial institutions and persons.
    • Knowledge of and experience with managing the risks presented by a large portfolio of securities such as credit, liquidity, and operational risks. This knowledge and experience would include background with models and other methods to measure that risk, such as Value at Risk (“VaR”); policies, procedures and processes to mitigate that risk, including margin and hedging strategies; and governance principles to oversee the management of such risk.
